1. Introduction
Welcome to asja ("we", "us", or "our"). These General Terms and Conditions (the Terms) apply to the use of our website and to all services and products offered by us.
By visiting our website, making a reservation, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree, please refrain from using the website or our services.
These Terms apply to all offers, quotations, agreements, services, and products provided by us. They prevail over any terms and conditions of the customer, unless we explicitly agree otherwise in writing.
The version of the Terms applicable is the version in force at the time the agreement is concluded.
2. Definitions
For the purposes of these Terms, the following definitions apply:

User: any natural or legal person who accesses or uses the Website.

Customer: any natural or legal person who enters into an Agreement with us.

Consumer: a Customer who is a natural person acting for purposes outside their trade, business, craft, or profession.

Business Customer: a Customer acting in the course of a trade, business, craft, or profession.

Agreement: any agreement concluded between us and a Customer concerning the provision of Services or the sale of Products.

Offer: any offer, quotation, or price indication made by us, whether via the Website, e-mail, social media, or other communication channels.

Services: all services provided by us, including but not limited to overnight stays at the guesthouse and photography-related services.

Products: all goods offered for sale by us, including physical products, digital products, artworks, ceramics, and photo prints.

Right of Withdrawal: the statutory right of a Consumer to withdraw from a distance contract within 14 calendar days, in accordance with applicable law.

In Writing: communication in a durable written form, including e-mail. Registered mail is required only where mandatory by law.

4. Services
4.1 Guesthouse
​Reservations

Reservations can be made via the Website or by e-mail. Online reservations and payments are processed via Bookingmood and Mollie. Reservations made by e-mail must be paid in full in advance.

A reservation is confirmed only once full payment has been received.

All prices are stated in euros (€) and include Belgian VAT at the applicable rate and city tax, unless explicitly stated otherwise.

Business Customers wishing to apply the VAT reverse-charge mechanism must contact us by e-mail prior to booking.

Check-in is available from 3:00 PM; check-out must take place no later than 12:00 PM (noon).
Cancellation Policy
-
Cancellations up to 4 weeks before the start date are eligible for a 100% refund, minus a €25 administration fee.

Cancellations up to 14 days before the start date are eligible for a 50% refund.
-
Cancellations made less than 14 days before the start date are non-refundable.
Hygiene
-
After each booking, we block the calendar for one day to ensure we have enough time to thoroughly clean the guesthouse.

Between reservations, we wash linens - bed sheets, pillowcases, slippers, bathrobes and towels - at the highest appropriate temperature.

We carefully clean the entire guesthouse, including floors, cabinets, and bathroom areas, and we give extra attention to high-touch surfaces such as light switches, doorknobs, and remote controls.

If you are staying longer than three nights and would like fresh bed linen, please let us know.
You are also welcome to ask for new towels at any time during your stay.
House Rules

The entire building is smoke-free and vape-free.

We love your pets, but they are not allowed inside the building.

A cleaning fee of €300 will be charged if the smoking or pet policy is violated.

The room accommodates a maximum of 2 guests. The number of guests must be specified at the time of booking.

Visitors and invitees of guests must be announced upon arrival, be accompanied by the guest at all times, and may not stay overnight between 11:00 PM and 10:00 AM.
Children

At asja, we have one baby travel bed available for one baby / child. To ensure a comfortable stay, please inform us of the presence of a baby during the reservation process. For safety reasons, we kindly request that the child is always supervised by an adult.
Responsibility During Stay

Guests are responsible for any damage to or loss of our property caused during their stay.

The possession or storage of hazardous, flammable, illegal, or prohibited items on the premises is strictly forbidden.

Guests must comply with all applicable laws and local regulations.
Photography and Video
-
We encourage you to take as many photographs as you want from your stay and share them with your friends on social media. However, our permission is required for using photographs and videos taken in the building for commercial or public purposes. If you wish to use one of our spaces for a commercial photo / video production, please ask us in advance as prior written consent is required for any commercial, editorial, or public use of images or videos taken on the premises.
5. Products (Webshop)

We do our best to describe and photograph all Products as accurately as possible.

Prices are listed in euros (€) and include Belgian VAT, unless stated otherwise.

Delivery costs are not included in the listed prices and will be shown before you complete your order.

Delivery times may vary depending on the Product.

Business Customers wishing to apply the VAT reverse-charge mechanism must place their order via e-mail.
Right of Withdrawal (Consumers only)

Consumers have the right to withdraw from a distance purchase within 14 calendar days from receipt of the Products, without giving any reason.

Return shipping costs are borne by the Consumer, unless otherwise agreed.

Products must be returned unused, undamaged, and in their original packaging, including all accessories and labels.
-
Refunds are processed only after the returned Products have been received and inspected.
Exceptions
-
Custom-made or personalised Products are excluded from the Right of Withdrawal.

The Right of Withdrawal does not apply to Business Customers, unless explicitly agreed otherwise.
Damaged or Incorrect Delivery

Any damage, non-delivery, or incorrect delivery must be reported within 24 hours of receipt, accompanied by clear photographs.
Gift Vouchers (eGift Cards)

Validity: A gift voucher is valid for 24 months from the date of purchase. This means the voucher must be redeemed within 24 months. If it is used for an overnight stay, the stay must take place within 27 months from the date of purchase.

Exchangeability: Gift vouchers cannot be exchanged for cash.

Remaining Balance: In the case of partial use, the remaining balance will remain available as digital credit.

Loss/Theft: In the event of loss or theft, no compensation or replacement is possible.

Fraud: In case of suspected fraud, we reserve the right to invalidate the gift voucher.

It's not allowed to use a gift voucher to buy a new gift voucher.
6. User Obligations

Users and Customers must be at least 18 years old.

You agree to provide accurate and complete information when placing an order or making a reservation.

The Website may not be used for unlawful purposes, unauthorised commercial activities, or actions that interfere with its proper functioning.
7. Intellectual Property

All content on the Website, including texts, images, logos, designs, and photography, is protected by intellectual property rights.

You may not copy, reproduce, distribute, or otherwise use any content without our prior written consent.

Any unauthorised use may result in legal action and claims for damages.
8. Liability

We do our best to keep all information accurate and up to date, but mistakes can happen.

To the extent permitted by law, we are not liable for indirect or consequential damages.

Our total liability for direct damages is limited to the amount paid by the Customer under the relevant Agreement.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under mandatory law.
9. Governing Law and Jurisdiction
These Terms are governed by Belgian law. Any disputes shall fall under the jurisdiction of the courts of the Antwerp judicial district, unless mandatory consumer protection law provides otherwise.
10. Changes to the Terms
We may update these Terms from time to time. The most recent version will always be available on the Website and will apply from the moment it is published.
